Here’s one from the real estate law files:

“A California real estate agent who hoped to obtain a listing visited the subject property and took copious notes on the property’s defects, planning to use the notes for the seller’s benefit if he won the listing. In a strange turn of events, the agent did not get the listing and ended up representing the buyers, instead. However, his prior notes on the property did not come out until after closing, leading the buyers to file suit for negligent nondisclosure.”
